Terms and Conditions

1 – Object

These general terms and conditions of sale aim to define the rights and obligations of the parties in the context of distance selling of goods offered in the online store www.mondokids.it.

2 – Territory and Coverage of the Offer

This version of the general terms and conditions of sale refers exclusively to sales made to consumers who have their domicile or residence in Italy.

3 – Contractual Documents

This contract consists of the following documents:

- These general terms and conditions of sale
- The order confirmation

The photographs illustrating the products on the site are not part of the contract and are provided solely for descriptive purposes.

4 – Order Receipt

Any order confirmation signed by the confirmation click constitutes an irrevocable commitment by the customer, which can only be questioned in the cases provided for in this contract under the articles "Right of Withdrawal" and "Order Execution."

5 – Order Acceptance

The contract is concluded only when Mondo Kids confirms the order.

The customer will receive an email notification confirming the order with all contract elements (including ordered products, prices, delivery dates, shipping costs).

Mondo Kids reserves the right to not confirm an order for any reason, especially in case of product supply issues or problems with the received order.

Mondo Kids will not be held responsible for errors in delivery due to inaccuracies or incompleteness in the order form filled out by the customer. Furthermore, Mondo Kids will not be liable for damages caused to products due to assembly or for delivery delays caused by the carrier.

6 – Product Availability

The offers on this site are valid as long as the listed products remain online and until stocks last.

Mondo Kids also reserves the right to inform the customer, at the email address associated with their profile, of the possible unavailability of one or more of the purchased products. In the case of purchasing an unavailable product, Mondo Kids will refund (to the payment card or PayPal account provided for the purchase or via bank transfer, whose details should be communicated later during registration) the price and shipping costs paid by the customer.

7 – Prices – Invoice

Prices are expressed in Euros and include 22% VAT.

The price guaranteed to the buyer is the one published on the site at the time of sending.

Product prices are final. They do not include possible delivery charges, which will be indicated in the order confirmation. The initial price on which a discount is applied is the official retail price provided by the brand.

8 – Payment

The customer wishing to purchase products must express this intention by placing a request directly on the website, in the section specifically dedicated, where, by following the procedures indicated, they will submit their order and make the payment.

Payment is due at the time of the order. The customer agrees to pay the agreed price for the ordered product (including product and transport costs) using the available payment methods.

The customer guarantees Mondo Kids that they have any necessary authorizations to use the payment instrument indicated during the order.

If Mondo Kids does not receive payment, Mondo Kids reserves the right to cancel the order.

If the customer chooses to pay in advance by bank transfer, the purchase price will be immediately due. In this case, the bank details for making the payment will be sent immediately after receiving the order. Delivery times will begin from the receipt of payment, so in the case of prepayment, delivery times may vary based on product availability at the time of payment.

Mondo Kids does not accept payments from accounts outside the European Union and will not be responsible for any costs arising from such monetary transactions.

Mondo Kids reserves the right to issue and send invoices (usually via email) exclusively in electronic form.

9 – Transfer of Risks

The transfer of risk to the customer occurs upon delivery of the products by the carrier. During the withdrawal period mentioned in article 13, the customer is responsible for the product as its custodian. If the product is damaged or destroyed during the customer's custody, the customer will bear all consequences.

10 – Order Execution

The order will be executed according to the terms specified on the Site and upon acceptance of the order by Mondo Kids, and in any case within 40 days from the order confirmation, subject to product availability and unless otherwise agreed by the parties.

If the stock runs out or the ordered product is unavailable, Mondo Kids will promptly inform the customer and specify any possible time for renewed availability.

11 – Delivery

The delivery area corresponds to the geographical coverage of the offer. Deliveries are made from Monday to Friday.

Products are delivered to the address provided by the customer. The delivery is considered made to the street level unless otherwise indicated. If available, the customer must specify a delivery request to the floor when confirming the order. If not otherwise specified during purchase, Mondo Kids does not include delivery to the floor or installation services for sold products.

Mondo Kids, subject to the provisions of article 6, undertakes to deliver the products to the address provided by the customer in the order, through the carrier responsible for transporting the products. Mondo Kids will not be held responsible for errors in delivery due to inaccuracies or incompleteness in the customer's order form. Additionally, Mondo Kids will not be responsible for damages to products caused by assembly or for delays in delivery due to the carrier.

Mondo Kids delivers throughout Italy. Deliveries to difficult-to-reach ZIP codes (e.g., Venice Lagoon) may result in variations in the indicated transport rates.

If the customer intends to place an order from abroad, they must provide a delivery address in Italy. Deliveries are made through carriers selected by Mondo Kids; P.O. Boxes are not considered valid delivery addresses.

The delivery document signed by the customer upon receiving the product will constitute proof of transport and release of the goods.

Upon delivery, the customer must check the contents, conformity, and condition of the products.

In case of delays, damages, total or partial losses, or other issues, the customer may contact Mondo Kids.

Therefore, upon delivery, Mondo Kids advises the customer to check the condition of the delivered products before signing the receipt.

If any anomalies are found, the customer must refuse delivery or write down their detailed and dated reservations. These reservations must be confirmed to Mondo Kids via email or registered mail with return receipt within three (3) working days from the product delivery.

12 – Product Pickup in Case of Customer Absence

If the recipient is absent during delivery, the carrier will leave a delivery attempt notice at the delivery address provided by the customer. If the recipient is absent again on the second delivery attempt, the products must be picked up at the address and in the manner indicated by the carrier.

If the products are not collected within the timeframe set by the carrier, they will be returned to Mondo Kids, which reserves the right to refund the product price, leaving the shipping costs to the customer's responsibility.

13 – Right of Withdrawal

The customer has the right to withdraw from the Contract, without any penalty and without specifying the reason, from the receipt of the order confirmation sent by Mondo Kids within fourteen working days from the receipt of the product at the delivery address.

The receipt date is considered the one on the delivery slip.

The customer may exercise the right of withdrawal by sending a communication (including recipient details, order number, and receipt date) to be sent to the email address info@mondokids.it.

If the product has already been delivered, the customer is required to return it to Mondo Kids. To do this:

The return period for the product is fourteen days from the withdrawal communication (if the customer ships the product, they must provide proof of shipment). For deadline purposes, the product is considered returned when it is delivered to the post office or accepting courier.

If the product has been delivered, the product's substantial integrity is a key condition for exercising the right of withdrawal. The customer must ship the product appropriately packaged and preserved; Mondo Kids does not accept returns of damaged products, but only those in normal condition and kept with standard care. Products damaged by detergents/additives, already assembled products, or damaged by the customer due to mishandling will not be replaced or refunded. The customer must include the original delivery receipt inside the return packaging. The shipping risks for returning the products are entirely at the customer's expense.

Return shipping costs are the customer's responsibility. If the customer exercises the right of withdrawal in accordance with these terms and conditions, Mondo Kids will refund the amounts paid by the customer using the same payment method used by the customer for the original transaction (credit card, PayPal, bank transfer), unless otherwise indicated by the customer.

The refund will be made free of charge within fourteen days from the date Mondo Kids became aware of the customer's exercise of the right of withdrawal.

As provided by Legislative Decree 6/9/2005 n. 206 and article 55 of the Consumer Code, the right of withdrawal regulated by these terms and conditions does not apply to goods made to order or clearly customized or which, by their nature, cannot be returned or are likely to deteriorate or alter quickly.

14 – Warranty

To ensure high-quality standards, products are subject to quality control procedures by Mondo Kids before being shipped. However, in case of issues, the customer benefits from the manufacturer's legal warranty lasting 24 months. In addition, Mondo Kids offers a "satisfaction or refund" warranty valid for 30 days after delivery, provided the product is used normally and in accordance with the instructions provided with the products and in the related manuals.

In any case, products sold are covered by the legal warranty against hidden defects as stated in articles 1641 and subsequent of the Civil Code.

Finally, some products have an extended warranty. In these cases, the warranty terms and duration are specified in the warranty certificate delivered with the product. This warranty does not cover damages, breakages, or malfunctions caused by failure to follow usage precautions.

To activate the warranty, the customer returns the product to Mondo Kids at their own expense, attaching the original order receipt.

The product will be replaced with an identical product and shipped to the customer at Mondo Kids' expense, except in cases of unavailability or discontinued production of the product. In this case, Mondo Kids will refund the product price to the customer.

15 – Use of the Website

Product descriptions and images on the site correspond to what is made available by Mondo Kids' suppliers. The product photos and presentation videos provided as part of the descriptive information are published on the site for descriptive purposes, taking into account that the quality of images, including exact color display, may depend on the software and equipment used by the customer when accessing the site. Mondo Kids is not responsible for issues caused to the customer by the use of the site and its technologies if they are not due to its own actions.

16 – Intellectual and Industrial Property Rights

Mondo Kids informs that the site, as well as all trademarks and distinctive signs used in relation to the sale of the products offered, are protected by applicable intellectual and industrial property rights, and that any form of reproduction, communication, distribution, publication, alteration, or transformation is prohibited. Mondo Kids reserves the right to take legal action to protect these aspects. Mondo Kids is not responsible for the trademarks and other distinctive signs appearing on the products it sells on the site, with respect to which the customer does not acquire any rights upon conclusion of the Contract.

17 – Protection of Personal Data

Mondo Kids is the owner of the personal data collected at the time of registration on the site, as well as the data subsequently provided during the purchase process, except for payment details, which are handled by the banking institutions through which the transaction occurs. For information regarding personal data processing, including the rights under article 7 of Legislative Decree 196/03, please refer to the detailed notice provided during registration on the Site https://www.mondokids.it.

18 – Electronic Signature

The "confirmation click" constitutes an electronic signature.

This electronic signature holds the same value as a handwritten signature between the parties.

19 – Completeness of the Contract

These general terms and conditions of sale constitute the entire agreement between the parties.

No other general or specific terms communicated by the customer may be included or override these general terms.

20 – Nullity

If one or more provisions of these general terms are considered invalid or declared so by law, regulation, or a final decision by a competent jurisdiction, the remaining provisions will retain their full force and effect.

22 – Applicable Law

The sales contract between the Customer and Mondo Kids is concluded in Italy and governed by Italian law.
